Terms and Conditions
  1. SERVICES
    1. REI Banc, Inc. shall provide the Subscriber with the capability to access the database, and to search for real property records included in the database as well as other services, which may be added periodically, at the sole discretion of REI Banc, Inc. REI Banc, Inc. reserves the right to add or withdraw data and/or modify or improve these services without notice.
  2. RESPONSIBILITIES OF THE SUBSCRIBER
    1. The Subscriber shall provide any necessary equipment for accessing REI Banc, Inc. Equipment shall be compatible with the systems utilized by REI Banc, Inc.: the determination of compatibility shall be made solely by REI Banc, Inc.
    2. The Subscriber is responsible for the confidentiality and the use of the Subscriber’s user name(s) and password(s), including any violation of the Agreement by anyone using the Subscriber’s account. The Subscriber must immediately notify REI Banc, Inc. in writing, if the user name(s) or password(s) is lost or stolen, or if the Subscriber finds that another party has unauthorized access to them. The Subscriber shall be responsible for all use of the services provided by REI Banc, Inc. through the Subscriber’s account until REI Banc, Inc. has been properly notified of an infringement.
    3. All information and software accessible through REI Banc, Inc. shall remain the sole and exclusive property of REI Banc, Inc. The Subscriber agrees to respect and comply with all copyright notices applicable to each edition of the RE-Source® database. The Subscriber agrees not to disclose and, in fact, shall prevent disclosure to a third party any of the information it has received from REI Banc, Inc. without prior written consent of REI Banc, Inc.
  3. WARRANTY – LIMITATION OF LIABILITY
    1. The data provided through REI Banc, Inc. is compiled from various public records. REI Banc, Inc. will also obtain information from private sources, including title plants, brokers and appraisers. Although it endeavors to provide current, updated information from its private and public sources, REI Banc, Inc. makes no guarantee that such information is accurate. Errors may occur in the process of compiling the information or converting records into electronic data form. The Subscriber should not make financial commitments or decisions based solely on data provided by the REI Banc service without first verifying the data in question with the appropriate public authority. REI Banc, Inc. SHALL NOT BE LIABLE FOR ANY DAMAGES FROM THE USE OF THE DATA, WHETHER DIRECT OR INDIRECT, SPECIAL OR CONSEQUENTIAL.
    2. Subscriber acknowledges and agrees that the completeness of each of these REI Banc, Inc. services is limited to the ability to search for “key words” so that, if an indexed description in the property records does not contain said “key words”, the search may generate an incomplete listing.
    3. REI Banc, Inc. shall not be responsible for any failure or delay in performance under this Agreement, nor shall REI Banc, Inc. be responsible for any direct or indirect damages caused by interruption of the service.
  4. APPLICABLE LAW
    1. The subscriber shall abide by the laws of the State of Kansas.
    2. K.S.A. 21-3914. Provides that
      1. No person shall knowingly sell, give or receive, for the purpose of selling or offering for sale any property or service to persons listed therein, any list of names and addresses contained in or derived from public records except:
        1. Lists of names and addresses from public records of the division of vehicles obtained under K.S.A. 74-2012, and amendments thereto;
        2. Lists of names and addresses of persons licensed, registered or issued certificates or permits to practice a profession or vocation may be sold or given to, and received by, an organization of persons who practice that profession or vocation for membership, informational or other purposes related to the practice of the profession or vocation;
        3. Lists of names and addresses of persons applying for examination for licenses, registrations, certificates or permits to practice a profession or vocation shall be sold or given to, and received by, organizations providing professional or vocational educational materials or courses to such persons for the sole purpose of providing such persons with information relating to the availability of such materials or courses; and
        4. To the extent otherwise authorized by law.
      2. Violation of this section is a class C misdemeanor.
